in mali and what they are doing there. is this worrying the obama administration? is there support for this? >> well, obviously the united states is providing refueling facilities for the french warplanes so, yes, the united states is playing a role already. i think there are no comfortable choices and that's one of the realities across the region today, whether it's in mali or syria, post revolution egypt and libya. the united states doesn't have a grand strategy. it's looking at each case individually. the reality is that with islamists taking over northern mali, which is larger than france, just that part of it, this then creates a greater threat throughout the region. and unfortunately the outside world dithered for way too long in trying to figure out a response and to the earlier point, the fact is the africans can't do it themselves. there's been talk for two decades about creating an africa rapid deployment force and they haven't been able to bring it together, provide training, cohesion, command and control and as a result there is no local or regional alternative. >> afri

this earlier today. what's your take on the obama administration's signal here to the bankers? >> in a sense it's an amazing political pick in that the obama administration is banking on the idea that the elite media and politicians will see the word prosecutor in mary jo white's resume and say that means she must be tough on crime forget that she hasn't been a prosecutor for a decade and has been defending the biggest most powerful wall street c.e.o.'s in the country. politically, it's banking on voters, on the elite media simply not knowing who she really is. i think as a citizen as somebody concerned with the fact that the administration hasn't prosecuted a single wall street banker connected to the financial crisis, i think this is a terrible pick. i think wall street is celebrating right now saying the person who's in in the s.c.c. looks like she's going to get tough on us, but we know she has a record of defending our interest. >> >> cenk: the new york times explains she's not going to face much opposition from the republicans. >> shocking. >> cenk: michael david and i are clear on this.

, t.j. this is certainly a setback for the obama administration. the white house sharply criticizing this ruling and pointing to the fact that presidents going back 150 years have engaged in appointments, recess appointments. ronald reagan made more than 200. george w bush made more than 100. at issue in this instance is the senate technically in recess when they are in a pro forma session. pro forma means that senators aren't really here. they're not getting any work done. but they are gaveling into session every few days. the obama administration has argued that means that the senate is in recess. this court ruled otherwise and disagreed with the obama administration. republicans are praising this ruling. today they are saying it was the right ruling and that president obama really engaged in overreach when he made those appointments. so to your second question, t.j., what happens now, at this point in time the justice department not weighing in on what it will do next. but if you talk to legal analysts, they believe that the administration will take this to the supreme court. so t
